Amputation Compensation Claims

If you are unfortunate enough to have lost a limb as a result of an accident, the effect on your life can be devastating. P R Scully is a firm of personal injury solicitors who can offer expert help for your amputation compensation claim.

If you have lost an arm or a leg, your ability to work and live independently will be significantly impacted.

You will receive compensation for the injury itself – but the bulk of compensation that you could receive is likely to be for future lost earnings, future care, future medical treatment and any adaptations to your home.

Amputation claims help people who’ve suffered the loss of a limb to meet their future needs following this serious injury.

Amputation compensation claims process

The early stages of your treatment following leg amputation or arm amputation will be covered by an Immediate Needs Assessment. As you recover from your loss of limb injuries, we will formulate a long-term plan as your personal injury solicitors.

An amputation injury claim has to bear many factors in mind. With the loss of a limb comes a possible loss of future earnings, and there will be practical impacts of living with one arm or one leg, including medical costs and adaptations to your home for living with such injuries.

Amputation claim and negligence

If your amputation injury was caused as a direct result of negligence, or by medical negligence or surgical errors, this can affect the amputation compensation amounts issued.

As specialist amputation lawyers, we are best placed to assess the impact that your serious injury has on your life and your future prospects, including financial losses through loss of earnings. We are experienced in successfully pursuing medical negligence claims.

What’s covered in an amputation compensation claim?

Whether you’ve lost a limb in a road traffic accident, in an accident at work or at home, or your amputation occurred as a result of medical negligence, you may be entitled to compensation for various aspects of your life that have been impacted.

How much compensation can vary, but as experts in amputation compensation claims, we can advise you how much compensation you could expect to receive for your loss of limb injury. Here are some of the areas that are considered when evaluating the amount of an amputation compensation claim:

Ongoing medical treatment

As well as medical treatments related to the loss of a limb, there may be medical costs related to managing physical pain, disability and related conditions. Occupational therapists may be involved and it’s possible you may require rehabilitation support too in the future after you’ve suffered a limb loss.

Care plan for amputation cases

If you need care and rehabilitation support in the future, we will arrange for a care plan to be drawn up to ensure that you have adequate financial provision for your care needs to be covered for the remainder of your life.

Prosthetic limbs

You may also need a prosthetic limb after you’ve had a limb amputated. The fault insurer is obliged to pay for whichever one suits you best.

It may be that you need several different types of prosthetic limbs depending on the activities that you want to carry out in your life. If you have one leg, for example, a prosthetic leg for day-to-day use would not be suited for more active outdoor pursuits.

More advanced prosthetic limbs may have a limited lifetime before they need to be replaced and we need to make sure that there is financial provision to cover you for enough replacements for the remainder of your life rehardless of the disability incurred.

Adaptations for living with an amputation injury

If your house needs to be adapted, we will ask a specialist architect to prepare a report setting out what adaptations need to be made. If your own home is not suitable for adaptation, we will ask the insurers to buy a suitable alternative for you.

Contact PR Scully personal injury solicitors if you have suffered limb loss, whether through an accident or medical negligence and would like to start a compensation claim.

How Will I Pay for My Amputation Claim?

Because we understand that our clients may not be able to pay for legal costs for personal injury claims up front, we usually give our clients the option of a conditional fee or working on a ‘no win no fee’ basis.

No win no fee amputation claims means that we will do all the necessary work on limb compensation claims and will only be paid if the case is successful. Sometimes, that means that we will do a lot of work towards an amputation compensation settlement, as we gather evidence for amputation claims, but do not end up being paid with the no-win no no-fee approach.

If we do win the amputation claim but cannot recover all our fees, we ask clients to pay for some of our fees from their amputation compensation. Some firms call this a success fee.

We always agree to limit any charges to our clients to a maximum of 25% of their amputation compensation damages when we work on a no win no fee basis.

As a specialist amputation solicitor with years of experience in serious injury claims, we can advise you about amputation lawsuit settlements from cases similar to yours whether you have suffered toe amputation, hand amputation, leg amputation, arm or any other amputation when you decide toclaim compensation using us as your personal injury lawyers.
