Tattoo compensation claim

Tattoo Compensation Claims

If you are unfortunate enough to have suffered a tattoo injury or a personal injury in the tattoo studio you may be entitled to make tattoo compensation claims.

Tattoo claims can arise after a poor tattoo, tattoo mistakes, an allergic reaction, an infected tattoo, complications during laser tattoo removal, issues with tattoo ink, or any tattoo negligence you experince in general.

Tattoo injuries needing medical treatment, often leading to tattoo infections, are frequent in the tattoo industry.

Tattoo procedure involves the placement of pigment onto the skin’s dermis, the layer of dermal tissue underlying the epidermis.

After initial injection, pigment is dispersed throughout a homogenised damaged layer down through the epidermis and upper dermis, in both of which a presence of foreign material activates the immune system’s phagocytes to engulf the pigment particles.

The Risks of Tattooing

The most common method of tattooing the body in modern times is the electric tattoo machine, which inserts ink into the skin via a single needle or a group of needles that are soldered onto a bar, which is attached to an oscillating unit.

The unit rapidly and repeatedly drives the needles in and out of the skin, usually 80 to 150 times a second.

This modern procedure is ordinarily sanitary and risk free with health and safety issues at a minimum. The needles are single-use needles that come packaged individually. The tattoo artist must wash his or her hands and must also wash the body area that will be tattooed.

Disposable latex gloves must be worn at all times and the wound must be wiped frequently with a wet disposable towel of some kind. The equipment must be sterilized in a certified autoclave before and after every use by the tattooist.

Tattoo Negligence

Below are examples of the possible risks from negligence when receiving tattoos from a tattoo artist in an unsanitary environment or one that fails in their duty for health and safety:-

  • Allergic Reactions
  • General Infection
  • Hepititis
  • Herpes Simplex Virus
  • HIV
  • Tetanus
  • Tuberculosis
  • Bruising
  • Scars
  • Injuries

If the administering of your tattoo caused you serious bruising or infection that meant you had to seek medical attention, you may well be eligible for a tattoo negligence compensation claim.

If you have suffered from one example of the above or if you are suffering more permanent issues of disfigurement like tattoo scarring, then contact our specialist team and they will be able to advice you about whether you can make a claim for compensation.

Tattoo Injury Claims

Our legal team are personal injury lawyers with expertise in tattoo injury compensation claims who operate with an intimate understanding of national accident law in the UK.

PR Scully also operates a no win no fee claim system. This means people can potentially receive a compensation settlement without spending money.

As well as claiming for any pain from tattoos, suffering and inconvenience, you may be able to claim back additional costs such as:

Remedial Procedures – if you have to have your tattoo procedure later corrected or removed, the additional cost involved could form part of the claims against the tattoo artist or the tattoo parlour that carried out the original procedure.

Loss of income – if you need to take additional days off work or you are unable to go back to work due to the negligence of the practitioner or artist carrying out the tattoo, your loss of income will form part of your claim.
