Our staff recently settled a case for a client who was not treated by a hospital as quickly as she should have been, causing permanent damage to one of her fingers. The fracture that the client suffered ought to have been treated with definitive manipulation and K wire stabilisation using dorsal blocking splints within 2 weeks of the injury for treatment to be effective. In our client’s case, this failed to take place as she was only admitted for treatment 6 weeks after the injury had occurred. Breach of duty was admitted in full by the Defendant Health Trust, and causation was partially admitted. Numerous medical reports were obtained, and a Schedule of Loss was prepared and served upon the Trust’s Solicitors. Our client received a five figure sum for her pain, suffering, loss of amenity and special damages.
