Mr C Secures Five-Figure Settlement following roundabout collision
Our client, Mr C, came to us following a road traffic accident that occurred in 2023 when a third party failed to give way at a roundabout.
Liability for the accident rested with the other driver, whose insurer was responsible for meeting any damages arising from the collision. As a result of the accident, Mr C suffered injuries together with associated financial losses and other damages.
The claim was initially submitted through the Ministry of Justice Portal. However, as the full extent of Mr C’s injuries and losses became clearer, it became apparent that the value of the claim was likely to exceed the Portal limits. The matter was therefore removed from the Portal and pursued through the courts, with an application anticipated to place the claim into a higher damages bracket once all medical evidence had been finalised.
To properly assess the impact of the accident, we obtained evidence from four independent medico-legal experts covering the various aspects of Mr C’s injuries and ongoing symptoms. This detailed medical evidence enabled us to build a comprehensive picture of the accident’s effect on our client’s health, daily life and future prognosis.
Despite clear evidence supporting the claim, the Defendant’s representatives failed to make any reasonable offers to settle the matter. As a result, we took the decision to issue court proceedings to protect Mr C’s position and ensure that the claim continued to progress.
The case advanced through the litigation process and was ultimately listed by the Court for a Directions Hearing. Following the Court’s involvement and the strengthening body of evidence supporting the claim, the Defendant’s solicitors reassessed their position.
Shortly before the matter progressed further through the Court process, the Defendant’s solicitors made a sensible five-figure settlement offer in respect of Mr C’s injuries and financial losses.
Having carefully advised our client on the offer and the risks and benefits of continuing litigation, Mr C accepted the settlement, bringing the claim to a successful conclusion without the need for a final trial.
This case demonstrates the importance of pursuing court proceedings where insurers fail to engage constructively with a claim. Through detailed medical evidence, robust negotiation and a willingness to litigate, when necessary, we secured a substantial five-figure settlement for our client and achieved a successful outcome after several years of litigation.
