MR D

Workplace Back Injury Claim

Mr D Receives Five-Figure Settlement Following Workplace Lifting Injury

Our client, Mr D, suffered a serious back injury whilst carrying out his normal duties at work in 2024.

On the day of the accident, Mr D was working alongside a colleague moving a large piece of glass weighing more than 50 kilograms. During the lift, his colleague lost control of their side of the glass due to wet conditions, leaving Mr D to unexpectedly bear the full weight of the panel.

As a result, Mr D sustained a significant injury to his back. The injury had a profound impact on his ability to work and ultimately left him unable to continue carrying out the physical demands of his role, forcing him to leave his employment.

The claim initially proceeded through the Employers’ Liability Portal (ELPL). However, as medical and financial evidence was gathered, it became clear that the value of the claim exceeded the Portal’s upper limit of £25,000, requiring the matter to be removed from the Portal and pursued as a higher-value claim.

To fully investigate the extent of Mr D’s injuries and future prognosis, we obtained extensive medical evidence. Mr D was assessed by three independent medical experts and two consultant specialists, with ongoing symptoms ultimately leading to a referral for pain management treatment. This expert evidence was crucial in demonstrating the long-term impact the injury had on his health, employment prospects and day-to-day life.

Throughout the claim, our team worked closely with Mr D to ensure all aspects of his losses were properly documented and valued, including the effect the injury had on his ability to continue working in his chosen occupation.

Following detailed negotiations, the Defendant’s insurers adopted a sensible approach and agreed to make a substantial five-figure settlement. As a result, Mr D received compensation for his injuries and losses without the need for court proceedings or litigation.

This case highlights the importance of obtaining comprehensive medical evidence in workplace injury claims, particularly where an injury has serious consequences for a person’s career and future earning capacity.
