Our specialist serious injury team has successfully secured compensation for a client who suffered significant injuries, including a brain injury, after being knocked from his motorbike in a road traffic accident.
The collision occurred when our client was struck by another vehicle, causing him to be thrown from his motorcycle and sustain multiple serious injuries. These included a broken wrist, a fractured nose and a brain injury, together with ongoing physical and psychological symptoms. He subsequently required surgery to treat his orthopaedic injuries and went through a prolonged period of recovery.
Following the accident, our client was unable to work for a period of time and suffered a loss of earnings as a direct result of the Defendant’s negligence.
We submitted a detailed Letter of Claim to the Defendant’s insurer, who accepted liability for the accident. Despite the admission of fault, the Defendant insurer failed to make any reasonable offers to settle the claim.
Given the complexity of our client’s injuries, particularly the brain injury, we instructed a team of specialist medical experts to assess the full extent of his condition and future prognoses. Expert evidence was obtained from an Orthopaedic Surgeon, Psychologist, Neurologist, Neuropsychologist, ENT specialist and Physiotherapist. Their reports provided detailed evidence regarding the impact of the injuries on our client’s daily life, employment and future needs.
As meaningful settlement discussions were not forthcoming, we prepared and issued court proceedings to protect our client’s position. Comprehensive court documentation was drafted, including a detailed Schedule of Loss setting out both past and future financial losses arising from the accident.
The claim progressed through litigation, with all court directions being complied with and expert evidence exchanged between the parties. Following the Defendant insurer’s instruction of solicitors, negotiations commenced and constructive settlement discussions took place.
As a result of those negotiations, the claim was successfully settled during the course of litigation, avoiding the need for a trial. The compensation secured reflects the significant impact that the accident and brain injury had upon our client’s life and ensures that he has been properly compensated for the injuries and losses caused by the Defendant’s negligence.
